In any case, NexDash's total aggregate liability to you—regardless of the number of individual claims—shall not exceed EUR 100 per user, unless caused by gross negligence or willful misconduct.

This limitation shall not apply to liability for:

• personal injury or death,
• product liability under German law,
• gross negligence,
• or mandatory statutory rights under GDPR.

You agree to indemnify and hold harmless Platform Horizons GmbH, its directors, officers, and affiliates from any claims, liabilities, losses, or costs arising from your breach of these Terms or misuse of the Site.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

The courts of Berlin, Germany shall have exclusive jurisdiction over any disputes related to the Site or these Terms. Platform Horizons GmbH does not participate in consumer dispute resolution schemes under § 36 VSBG.

13. Export Controls and Access Restrictions

Users are responsible for complying with local laws, including sanctions and export regulations that may restrict access to the Site or its content.

14. Termination

We may restrict or terminate access to the Site at any time and for any reason, especially for violations of these Terms or misuse.

15. Severability

If any part of these Terms is found unenforceable, the remaining provisions shall remain in full effect.

These Terms, along with our Privacy Policy, represent the entire agreement between you and NexDash regarding use of the Site.
